Proposed Canal Agreement: Kouga Municipality and SFB Canal Homeowners
I refer to our previous correspondence on this matter, as well as to the SFBRA Executive Meeting of last week where I was informed that a formal agreement had been signed between the Riparian Homeowners Association and the Kouga Council and wish to comment as follows:
- Following my discussions with you last week, you were of the opinion that no Agreement had been signed between the Riparian Homeowners and the Kouga Municipality.
- A Public Meeting in St Francis Bay on 16 March, 2006 confirmed the support of canal homeowners to form a Section 21 Company for Canal Maintenance and Dredging. There was agreement in principal that an agreement be entered into with the Municipality, subject to the reservations made by SFBRA being addressed.
- It was subsequently learnt that the Chairman of the Canal Committee had signed an Agreement with the Council prior to the Local Government Elections in February, 2006. This was over two weeks before the Public Meeting of 16 March, 2006. In this regard it would be interesting to learn who has the copy of the signed Agreement.
- The SFBRA are firmly of the view that the Chairman of the Canal Committee had no mandate to sign any Agreement with the Council prior to obtaining formal approval from canal homeowners regarding the exact detail of the proposed agreement. It is important to note that at no stage was the Draft Agreement presented to the Meeting for discussion and approval by those present.
- At this stage therefore, the SFBRA Executive Committee will continue to strongly oppose the Draft Agreement as it does not address the concerns supplied to the Canal Committee by the SFBRA. In discussions on 15 March, 2006 the Canal Committee undertook to ensure that all our objections were satisfactorily addressed.
Bearing the above points in mind we wish to make the point that in the event of any formal agreement being signed between the Council and the Canal Sub-Committee that this Association will take whatever action is required to protect the interests of all affected homeowners.
